Cyber Security Act takes effect on Aug 26

The Cyber Security Act, a legislation aimed at enhancing the nation’s cyber security through compliance with specific measures, standards and processes in managing such threats, has come into force since Aug 26.

PMO SAID.

In a statement, the Prime Minister’s Office (PMO) said the Act had previously obtained the royal assent from the Yang di-Pertuan Agong on June 18 and was later published in the Federal Gazette on June 26.

The Act, which is designed to establish the National Cyber Security Committee, define the duties and powers of the Chief Executive of the National Cyber Security Agency and outline the functions and responsibilities of the heads of the National Critical Information Infrastructure (NCII) sectors and NCII entities, has been enacted.

This includes the management of cyber security threats and incidents against NCII, regulation of cyber security service providers through licensing and provisions for related matters.

“In accordance with subsection 1(2) of the Cyber Security Act, the PM as the minister responsible for cyber security, has set Aug 26 for the official enforcement of the Act,” the statement said.

PMO added that the regulations made under the act were also enforced simultaneously, including the requirement to report cyber incidents within six hours of an NCII entity becoming aware of the cyber security incident.

The report must be made through the National Cyber Coordination and Control Centre System (NC4 System) as stipulated under the Cyber Security (Notification of Cyber Security Incidents) Regulations 2024 [P.U.(A) 220/2024].

The Act was passed by the Dewan Rakyat last March 27 and in the Dewan Negara on April 3. – TMR
